Amendments to the act on National Labour Inspectorate: who will pay for the inspectors’ mistakes?

Businesses may face additional costs as a result of incorrect decisions issued by the National Labour Inspectorate (PIP). Since they are immediately enforceable, employers may be required to pay social security contributions before the matter is resolved. Even if a court later determines that the obligations were unfounded, recovering costs from the State Treasury may prove difficult, as it would require demonstrating both the loss suffered and a direct causal link to PIP’s actions – Bartosz Wszeborowski and Wiktoria Dziuba comment for Dziennik Gazeta Prawna.
