Unjustified delay will block the return to full-time employment after the rehabilitation benefit has been exhausted – Supreme Court ruling
07.07.2021
Immediate notification to the employer of a willingness to return to full-time employment after the rehabilitation benefit has been exhausted (…) should be measured by the former employee’s diligence in reactivating employment, assessed in the given circumstances as behaviour without unjustified delay. Actions taken to obtain social insurance benefit do not affect the assessment of whether the beneficiary has complied with the requirement of immediate notification of the intention to return to work. – Kinga Polewka comments for Rzeczpospolita.
