A recent ZUS interpretation suggests that social insurance contributions are not required for company housing offered to employees for a peppercorn rent. This development presents an attractive, contribution-free benefit option for companies and their employees. – Sławomir Paruch and Anna Kencel comment for Rzeczpospolita.

Executives and overtime: to pay or not to pay?

While overtime work, meaning work beyond contracted hours, typically requires employers to provide fair compensation, there are exceptions. This raises the question: Are executives entitled to overtime pay, and if so, under what circumstances? The answer, far from straightforward, hinges on factors such as the scope of their job responsibilities and the level of autonomy in managing their work schedule. – Kinga Polewka-Włoch and Agata Ankersztajn comment for Rzeczpospolita.

Sick leave: not a vacation

Employers are increasingly grappling with employees who travel abroad while on sick leave. Employees often justify these trips by citing the need for a change of scenery and improved recovery, even when evidence suggests the vacation was booked before their alleged illness. The situation becomes particularly problematic when social security benefits are involved. If an employee claims the trip was for medical reasons, and social security administration has not challenged their benefits, employers are left wondering how to address these potentially fraudulent practices. – Karolina Kanclerz, Łukasz Marzec and Maurycy Oroń comment for Rzeczpospolita.
