#Alert: New developments re: Polish travel restrictions related to coronavirus effective from 9 October

According to newest amendment to the regulation of the Ministry of Internal Affairs on temporary suspension or restriction of border traffic, all Turkish citizens travelling to Poland by air (plane) are exempt from the entry ban, regardless of point of origin of travel and the purpose of entry. The amendment facilitates the border crossing for all Turkish citizens starting from 9 October 2021. The exemption will be used by those who are already covered by one of other exempt category (e.g. workers authorized to perform work in Poland), as they no longer have to present any documents confirming exemption from entry ban. People who have not been covered by any of these categories so far – in particular family members wishing to accompany Turkish workers on their way to Poland – will also benefit, as they will no longer have to apply for individual approvals to the Border Guard for entry at the border. The same rules are provided for all foreigners holding valid residence rights in Turkey. The new regulations do not authorize to entry by other means (by land or sea) and do not lift obligatory post-entry quarantine. Beneficiaries of these new solutions should also obey “pre-coronavirus” regulations while entering Poland and therefore possess appropriate visas and work permits (if necessary).

Additional amendments also restore railway passenger traffic at the individual crossings with Russia and Ukraine.

It is also provided to introduce regulations allowing for entry to foreigners coming to Poland for business (economic) purposes. It will be possible only upon a written invitation from a Polish entity entered either in KRS or CEIDG, indicating such purposes and only if the travellers will document so to the Border Guard. The changes are to come into force on October 16. Business travellers will be also subject to standard entry, quarantine, stay and work rules in Poland, including to work permit requirement (when applicable).

Civil law contracts in the IT field. What to look out for?

Employment on the basis of civil law contracts enjoys unflagging popularity in many sectors, in particular in the broadly understood IT sector. This kind of employment is not always completely in accordance with the law. If the actual work is done in conditions more similar to employment contract, establishing employment relationship and reclassification of the civil law contract may take place. – Bartosz Wszeborowski and Piotr Kozłowski comment for IT Leaders.

The family of an employee from the EU will enter Poland easier

Even if they themselves are not citizens of any European country, under certain conditions, they will be able to take advantage of the simplified visa procedure and start to work in Poland faster. However, this does not automatically exempt them from obtaining all appropriate permits. – Kinga Polewka-Włoch and Ewa Sojak comment for Dziennik Gazeta Prawna.
